Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the mobile application (“App”) provided by Klass.lk (“we,” “us,” or “our”) for the purpose of facilitating mutual transfers among government servants. By accessing or using our App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the App.

1. App Usage

1.1 Eligibility: You must be a government servant and have the legal authority to enter into these Terms to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.
1.2 Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App solely for the purpose of finding and connecting with potential mutual transfer candidates. This license does not transfer any ownership rights to you.
1.3 No Government Affiliation: We are an independent entity and are not affiliated with any government agency or department. We do not have any control over government policies, procedures, or decisions related to transfers. Our App only acts as a platform to facilitate the matching of transfer requests.

2. User Responsibilities

2.1 Account Creation: To use the App, you may be required to create an account. You must provide accurate and complete information during the registration process and keep your account information up to date. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account..
2.2 User Content: You are solely responsible for any content, information, or materials you upload, submit, or transmit through the App. You retain ownership of your content, but by using the App, you grant us a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable license to use, display, modify, reproduce, and distribute your content for the purposes of operating and promoting the App.
2.3 Prohibited Conduct: You agree not to engage in any of the following prohibited activities:
- (a) Violating any applicable laws, regulations, or government policies;
- (b) Impersonating any person or entity, or falsely representing your affiliation with any person or entity;
- (c) Uploading, transmitting, or distributing any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable;
- (d) Interfering with or disrupting the App’s functionality or servers;
- (e) Attempting to gain unauthorized access to any portion of the App or any other systems or networks connected to the App;
- (f) Engaging in any fraudulent or deceptive activities;
- (g) Collecting or harvesting any personally identifiable information from other users without their consent;
- (h) Violating the privacy rights of other users or third parties.

3. Disclaimers and Limitations of Liability

3.1 No Guarantee: We do not guarantee the accuracy, completeness, or reliability of the information provided by users through the App. We are not responsible for verifying the authenticity, eligibility, or suitability of any user or transfer request.
3.2 Third-Party Services: The App may include links to third-party websites or services that are not controlled by us. We are not responsible for the content, privacy policies, or practices of these third-party services. Your interactions with any third-party website or service are solely between you and the third party.
3.3 Indemnification: You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney fees) arising out of or related to your use of the App, violation of these Terms, or infringement of any rights of any other person or entity.
3.4 Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses arising out of or in connection with your use of the App or any interactions with other users.

4. Intellectual Property

4.1 Ownership: All intellectual property rights in the App, including but not limited to trademarks, logos, copyrights, and trade secrets, are owned by us or our licensors. You acknowledge that you have no right, title, or interest in or to the App, except for the limited license granted to you under these Terms.
4.2 Feedback: If you provide us with any suggestions, ideas, or feedback regarding the App (“Feedback”), you grant us a non-exclusive, worldwide, royalty-free, irrevocable, sublicensable, and transferable license to use, modify, reproduce, distribute, and otherwise exploit the Feedback for any purpose without any obligation to you.

5. Modifications and Termination

5.1 Modifications: We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time, with or without notice. We may also update these Terms from time to time. The most current version of the Terms will be posted on the App. Your continued use of the App after any modifications to the Terms indicates your acceptance of the modified Terms.
5.2 Termination: We may, at our sole discretion, suspend or terminate your access to the App, without prior notice, for any reason or no reason, including but not limited to your violation of these Terms or any applicable laws or regulations.

6. Governing Law and Dispute Resolution

6.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict of laws principles.
6.2 Dispute Resolution: Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Sri Lanka.

7. Miscellaneous

7.1 Entire Agreement: These Terms constitute the entire agreement between you and us regarding the use of the App and supersede any prior or contemporaneous agreements, communications, or understandings, whether oral or written.
7.2 Severability: If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
7.3 Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
